You have made the difficult decision to deregister your child. You have sent the letter to the headteacher, and the relief is palpable. But then, a new anxiety sets in: What happens when the Local Authority finds out? Can they force my child back into a mainstream classroom?

It is a common fear, fueled by horror stories on social media. But if you understand UK education law, you have nothing to fear. The short answer is no, the Local Authority cannot force your child back to school—provided you are giving them a "suitable" education.

What is a School Attendance Order (SAO)?

A School Attendance Order (SAO) is a legal directive issued by a UK Local Authority ordering a parent to register their child at a named mainstream or special school.

LAs do not hand these out randomly. An SAO is an absolute last resort. They are only issued if a parent completely ignores the Local Authority or outright refuses to prove that their child is being educated at home.

The Law: Section 437 of the Education Act 1996

To understand your rights, you need to know the law. Section 437 of the Education Act 1996 dictates exactly when a Local Authority is allowed to intervene in your home education.

The law states: "If it appears to a local authority that a child of compulsory school age in their area is not receiving suitable education, either by regular attendance at school or otherwise, they shall serve a notice in writing on the parent requiring him to satisfy them within the period specified in the notice that the child is receiving such education."

Notice the phrase "If it appears..." The LA cannot issue an SAO just because they disagree with home education. They can only act if they have genuine reason to believe you are doing absolutely nothing.

How Local Authority EHE Checks Actually Work

When you deregister your child, the school notifies the LA. Here is what usually happens next:

  1. The Initial Contact: The LA's Elective Home Education (EHE) team will write to you, asking how you intend to educate your child.
  2. The "Suitable Education" Proof: You simply need to provide a brief report or summary of your educational provision. You do not legally have to allow the LA officer into your home, though many parents choose to send a polite email outlining their curriculum.
  3. Case Closed: Once the LA is satisfied that the education is full-time, suitable for the child's age, and meets any special educational needs, they update their records and usually leave you alone for another 12 months.
⚠️ Warning for Special Schools: Remember, if your child attends a dedicated Special School arranged by the Local Authority (not a mainstream school), you cannot unilaterally deregister them. You must get the LA's formal consent to remove them from the roll.
